  • Preparation of Lasting Powers of Attorney (LPA): A LPA has to be prepared and signed by the donor, their attorneys and a certificate provider. We can act as certificate provider when preparing the LPA and advise you regarding the most appropriate way of appointing your attorneys and any instructions and preferences you may benefit from.
  • Registration of LPA/EPA: Before an attorney can act, the LPA has to be registered with the Office of the Public Guardian. We can oversee that process and submit the LPA for registration to the Office of the Public Guardian. Pre-October 2007, Enduring Powers of Attorney were prepared. These have to be registered when the donor is losing or has lost mental capacity. We can oversee that process, notify relevant parties and submit the EPA for registration to the Office of the Public Guardian.
  • Advising Attorneys: As an Attorney you have to act in accordance with the Mental Capacity Act 2005. We can advise you about your duties and responsibilities, who you should be liaising with, how you should be documenting your decision-making and financial record keeping. Ensuring you are acting in the best interests of the donor can sometimes be more complicated than first expected particularly if there are conflicting views within the family, inter-family transactions, gifts to be made or transactions at under-value.
  • Objecting to the Registration of an LPA/EPA: Whilst most LPAs and EPAs are registered without objections sometimes issues are raised making the process more involved. We can advise you as to how to raise an objection, whether that be because the donor is lacking capacity, situations of undue influence or if there are concerns regarding the appropriateness of the proposed attorney.
