Arbitration is an alternative to route to Court proceedings as a way of resolving commercial disputes. It is a contractually agreed process whereby parties agree to refer their dispute to one or more independent arbitrators to hear the parties’ respective cases and to reach a binding decision which is legally enforceable. Not all matters are suitable for arbitration but in the right case arbitration offers the parties an opportunity to select both a forum and a set of rules for determining their disputes that offers greater flexibility and commerciality than Court proceedings would do.
